1. This is a legal and binding contract between the Breeder and Purchaser listed above. Purchaser?s signature acknowledges receipt of all information concerning breed, sex, coat color, date of birth, sire, dam, breeder, care guidelines and vaccination and worming history, any other additional vet or medicinal treatments give by the breeder. As of the date of delivery, the puppy has received proper vaccinations and de-wormings. The buyer has been informed of all these and the future vaccinations and de-wormings due.

2 Purchaser has read and understands all the care guidelines provided. In addition, Purchaser understands that improper feeding, care and/or handling could result in the serious illness or death of the puppy they are adopting.

3. Puppies do not have full immunity until they have completed their vaccination series. For their protection, purchaser agrees not expose them to unknown areas, animals or people until their vet has completed the puppy?s vaccinations. Although your puppy has received the vaccinations listed above, they could still contract diseases until they are fully vaccinated. Follow your veterinarian?s advice on scheduling vaccinations. Giving core vaccinations closer than 3 weeks apart or farther than 4 weeks apart will result in the cancellation of this guarantee.

4. Breeder is not responsible for costs related to transportation to pick-up puppy, purchase of items or other services for puppy. Breeder will not be held liable for these costs if date of pup availability changes or due to any other circumstances out of the breeder?s control.

5. Purchaser must have the puppy examined by a licensed veterinarian within 72 hours of  pick up. The Breeder must be informed immediately of the examination results. A copy of the examination results must be forwarded from the examining veterinarian?s office, to the address or fax number given above, within 48 hours of examination. The failure to do so will result in the cancellation of this health guarantee.

6. 72 hour Health Guarantee: Any puppy leaving the Breeder, to the best of our knowledge, will be healthy and have been checked by our vet and issued a health certificate before traveling via any airlines.  I have taken every precaution to insure the safety and health of all of our puppies, but because I have no control over the puppy once it leaves our home, the Breeder accepts no responsibility for death or illness of puppies which may be caused by, or as a direct result of, travel or exposure to other animals and environments.  This guarantee does not cover any parasites, hypoglycemia or water poisoning.  It does not cover illnesses or injuries, which are a result of, or which could be caused by, travel, food, water, environmental changes or exposure, exposure to outside environments and/or animals, mishandling, neglect, improper feeding or care.  I do guarantee the health of the puppy for 72 hours after pickup or delivery for any life threatening illnesses, and a veterinarian must examine the puppy within the 72 hours after pick-up or delivery.  If the puppy dies or becomes sick with a life threatening illness not related to the exclusions listed above, within the 72 hour guarantee time, a replacement pup will be offered. The sick puppy must be returned to the Breeder at the expense of the Purchaser and the illness or cause of death will have to be confirmed by our veterinarian, State, or USDA Veterinarian Lab. Any claims as a result of this guarantee must be made within the 72 hour time period, accompanied by a licensed veterinarian?s statement and substantiated by diagnostic tests and full medical record, which our vet can verify. The Breeder reserves the right to have the puppy examined by our own vet or one of our choice and at our expense, to confirm the illness or cause of death.

7. Purchaser understands that they should not take the puppy anywhere it could come in contact with, or where dogs may have been until 2 weeks after the puppy?s fourth vaccination is completed as this could transmit parvovirus to the puppy. Areas of potential contact with parvovirus include but are not limited to: areas where dogs are walked, dog parks, pet stores, vet clinic floors, parking lots, near the feces of other dogs. Purchaser understands the puppy has been vaccinated for parvovirus as listed on page one of this contract. Purchaser understands that the puppy can still contract parvovirus and if the puppy contracts parvovirus, the Breeder is not responsible for any vet bills or death of puppy resulting from said disease.

8. Breeder will not be responsible for any medical expenses incurred. Purchaser is aware that owning a puppy entails veterinary care and understands that he/she will be responsible for all payments.

9. The finding of parasites shall not be grounds for declaring the dog unfit for sale.

10. No refunds or replacements will be given for issues involving marital, housebreaking, behavioral training, owner allergy, or existing pet difficulties.

11. Any physical problem which is, or could be, the result of injury, abuse or neglect is not covered by the guarantee.

12. This dog is guaranteed until 1 year of age against fatal and life altering congenital diseases (a veterinarian recommends euthanasia).  If any such condition is found it must be proven in writing from a licensed veterinarian and substantiated by diagnostic tests and full medical records. Defects that may be caused by environmental factors are excluded. (For example: allergies, thyroid, and illnesses due to overfeeding or feeding poor quality food). Minor, breed related, and treatable or correctable conditions or any condition which could go away or is considered to be a condition which a puppy will likely outgrow are not covered.

13. If the dog dies before it is one year of age, the Purchaser will pay to have a necropsy to ascertain the cause of death. If the cause is congenital, the Breeder will replace the dog. If no necropsy is performed, the Breeder will have no obligation to replace the puppy even if the cause of death was congenital. In the event a puppy dies, a necropsy must be performed to determine the cause of death. Such a necropsy must be performed by an accredited institution set up for such procedures, such as NC State College or NC Department of Agriculture. This shall be done at the expense of the owner of the pup. A necropsy performed by a local veterinarian will not be accepted. The necropsy report along with any and all medical records will accompany any written request for replacement

14. A dog will be replaced as follows: The dog must show the defect by one year of age. Breeder must be notified of the problem within 2 business days of the licensed veterinarian?s determination. Breeder must be provided a full copy of all veterinary records from the veterinarian?s office and receive a release to all and any veterinary records. The Breeder has the right to have this animal examined by a veterinarian of their choosing. If a dispute over the diagnosis occurs, a third mutually agreed upon veterinarian will make the final determination. The Breeder will provide a replacement puppy of equivalent value. No refund in part, or full will be given, only a replacement dog. No replacement puppy will be given if the puppy has been bred or euthanized without Breeder?s permission.

15. Purchaser is responsible for transportation costs to and from the Breeder for a replacement puppy. A returned puppy must be returned to the Breeder in good condition, other than the specified problem, at the Purchaser?s expense. The owner will then qualify for a replacement puppy from the next available litter.  If the puppy is returned in poor condition and not up to date on all vaccinations, the breeder has the right to not give a replacement puppy. At the time of returning a puppy, you must include all paperwork, such as registration, health records, and any medication the puppy is on.

16. All dogs are sold as companion animals only and are not guaranteed to be fit for breeding or any other purpose, nor is it guaranteed to grow to a particular size or weight. Companion dog, as defined herein, is an animal sold as a pet, rather than for breeding or show purposes.   Purchaser agrees to have this dog altered [spayed or neutered] by the age of six months. Purchaser will have a certificate of spay or neuter sent to the seller from the Veterinarian performing the surgery. This must be sent within (5) five business days of spay or neutered procedure via regular mail or fax.

17. Purchaser further understands, any attempt on the part of the Purchaser to use the puppy in a breeding program will result in legal action for breach of contract. Should such actions take place; any/all legal fees associated with this matter will become the responsibility of the Purchaser to include any/all Breeders attorney fees. Any such litigation shall occur in the State of North Carolina in Davie County and any/all expenses related to travel will also be at the Purchaser's expense.  If the Purchaser fails to comply with the Non-Breeding Agreement and a litter is produced by the PUPPY/DOG, the Purchaser understands that the Breeder will have the intent to pursue suit against the Purchaser for the monetary value of each and every puppy produced. The monetary value for each puppy will be equal to the purchase price of the puppy/dog.  Purchase Price: ________.
